Asset Compliance

Our Asset Compliance team actively respond to and investigate reports involving building site concerns, illegal works within the road reserve and works in contravention of a permit.

We ensure works are in accordance with the Mornington Peninsula Shire Community Amenity Local Law 2022 and the Road Management Act 2004.

Types of cases we can investigate

  • Vehicle Crossing works
  • Vegetation removal
  • Landscaping and earthworks on road reserve
  • Road Opening and Drainage connection works
  • Traffic Management works
  • Hoardings/Occupation without permits
  • Building site concerns (noise, dust, messy site, rubbish, inadequate fencing, concrete wash, skip bins, sanitary facility, and sediment controls to protect stormwater contamination)

Investigating a report

Upon the submission of a report to Council, an Asset Compliance Officer will conduct an inquiry and assess the following aspects:

  • Has a permit been obtained?
  • If yes, have works been conducted in accordance with the permit?
  • If illegal works have taken place within the road reserve or if works are in contravention of a permit, an Asset Compliance Officer will follow the necessary steps to achieve compliance, reinstatement works and associated costs.

Possible remediation actions

If a breach is identified by the Asset Compliance Officer, action may be taken. Depending on the severity of the breach and level of cooperation by the alleged offender, Council may do one or more of the following:

  • Negotiate compliance
  • Issue a Notice to Comply
  • Issue an official warning
  • Issue an Infringement Notice
  • Compile a Brief of Evidence to proceed to Court under the Mornington Peninsula Shire Community Amenity Local Law 2022 and/or Road Management Act 2004
  • Prosecution
