The Mornington Peninsula Shire (“Shire”) provides information and enables users to process various transactions via this website (“Transactions”), including but not limited to application fees, licenses, permits or infringements. Your continued use of this website constitutes acceptance of these terms and conditions.
Whilst the Shire makes efforts to maintain the accuracy of information on this website, it disclaims any warranty or representation, express or implied, about its accuracy, completeness or appropriateness for a particular purpose. The information provided to you through this website is solely for your personal and/or internal business needs. The use of this information is restricted in that you may not remove any proprietary rights notices, change the information or make it available to third parties.
The use of the website to make payments in relation to Transactions is dependent on you being at least 18 years of age and having the legal capacity to contract in Australia. If you are using a credit card to process a Transaction payment, you are declaring that the credit card is issued under your name and you will pay to the issuer all charges incurred. You may be charged a surcharge for using certain credit cards.
You agree to provide any relevant information, documents and attachments in the format and to the standards described for each Transaction, and you also understand that the information may be retained in electronic form. Where information is requested by another person, the requesting party is deemed to be the recipient's agent and is presumed to have obtained the consent of the recipient to receive the information in electronic format. If the Shire is required to provide information to you as part of the Transaction, you agree that the information can be provided through electronic means.
The use of the website to make Transaction payments does not abrogate any statutory requirements and all Transactions are subject to the relevant statutory and Shire approval processes. You agree that a Transaction may be subject to additional terms and conditions specific to that Transaction and agree to comply with such terms and conditions.
This website contains links to other websites operated by organisations other than the Shire. These links are provided for your convenience and should not be seen as an endorsement of those sites or the information they provide.
Privacy
The collection, use, and disclosure of your personal and health information via this website is governed by the Shire Privacy Policy.
The Shire may utilise a third party online website provider to facilitate Transactions and/or Transaction payments and you consent to the collection, use and disclosure of your personal and health information by and to such provider.
Confidentiality
You may request certain information be treated as confidential; however the final decision for making the document confidential resides with the Shire.
Website security
The Transactions are facilitated via a secure website(s). However, website security cannot be guaranteed and you acknowledge that any information you send via the website (including credit card information) may be intercepted by others. The Shire shall have no liability for the interception or loss of information through the website by unauthorised third parties.
Accuracy of Transaction information
It is your responsibility to verify that all Transaction information submitted is correct. You will not be able to change it once it has been submitted. Printing of the Transaction confirmation for future reference is recommended. The Shire shall have no liability for transactions which are incorrect due to inaccurate information or for loss of information caused by factors outside the Shire’s control.
Limitation of liability
Except as expressly provided by law, the Shire accepts no liability for any loss, damage or expense incurred or suffered as a direct or indirect result of the use of this website or a Transaction. The liability of the Shire to make any payment (by way of indemnity, damages or otherwise) is limited to the dollar amount of the Transaction forming the basis of the damage, or $10, whichever is less. You agree that any dispute in relation to your use of the website will be governed by the laws of Victoria, and shall be determined in that jurisdiction.
Incomplete Payments
If your Transaction payment is not successfully processed due to credit/debit card or other issues, your payment liability to the Shire will remain outstanding. If your payment liability remains outstanding you may be subject to penalties, interest and other charges. If you select an amount to be paid to the Shire and this payment is accepted but it is later found that the amount paid is insufficient you remain liable to the Shire for the balance.
Service Availability
The Shire makes no representation or warranty, express or implied, about the availability or response time of this website. The Shire has the right at any time without prior notice or any liability to you, to cancel or suspend the website or any or all of the Transaction services available and /or to substitute alternative services.
Amendment
The Shire may vary these terms and conditions from time to time without notification and it is your responsibility to ensure you are familiar with them before each use of the website.
