Commercial Health & Fitness Permit

  • Operate a health or fitness business and want to use Shire land, Crown Land or open space?

Positive health and wellbeing is fundamentally important for the community. The Shire encourages participation in safe, supervised health and fitness activities that enhance physical and social wellbeing within the local community.

The use of our open space and foreshore areas by commercial health and fitness groups must be managed to:

  • balance industry needs,
  • support safe, physical wellbeing activities,
  • provide protection of natural assets and
  • maintain community access and amenity.

If you operate commercial personal training or fitness activities on public land such as parks, you must have a Commercial Health & Fitness Permit.

Key Information

  • Please read the Commercial Health and Fitness Guidelines(PDF, 155KB).
  • Applications will only be taken from trainers who hold all relevant qualifications.
  • Group sizes must not exceed 20 participants per session.
  • Permits are issued annually and are valid for up to 12 months - from date of issue until 30 June each year.
  • Approved permit holders must carry their permit with them during training sessions.
  • Minimising impact on local amenity and compliance with permit terms is required at all times.
  • Non-compliance with the Shire's Commercial Health & Fitness Guidelines may result in a cancellation of your permit.
  • Please allow 4-6 weeks for processing

 

Crown Land

If you are operating on Crown Land, a Tour Operator Licence is required through the Department of Energy, Environment and Climate Action (DEECA). 

Once Council has received and assessed your application, if a Tour Operator Licence is required, Council will organise this on your behalf.  

As fitness providers are currently exempt from paying additional usage fees with DEECA there is no additional charge for a Tour Operator Licence.

Applications from registered companies must be made by the Director of the company and an ASICS report must be provided confirming the company director.

Fees

  • The fee for the 2024/25 Commercial Health & Fitness Permit is $360.00 (incl. GST)
  • Permits will be valid from date of issue until 30 June 2025
  • Pro rata fees are not applicable
  • Payment is required on application and is non refundable once permit has been issued
  • If your application is unsuccessful, you will receive a full refund of the permit fee

 

What documentation do I need to provide?

  • Certificate of currency/ insurance, for $20 million public liability.
  • National Fitness Industry Registration. Qualifications delivered by peak sporting bodies will be at the Shire's discretion.
  • Level 2 first aid certificate
  • Current CPR certificate
  • Working with Children Check if you work with participants under 18 years of age
  • If you are a registered company, you will need to provide a copy of the companies ASICS report confirming the director of the company
