Amendment C295morn: Creswell Street East, Crib Point - revised DCP

The Creswell Street East, Crib Point Development Contributions Plan (DCP) is an Incorporated Document in the Mornington Peninsula Planning Scheme. The DCP provides for the funding and delivery of road and drainage infrastructure required to service privately owned residential properties in Creswell and Cooma Streets, Crib Point.

The DCP specifically applies to properties at 1-73 Creswell Street (except 2 Creswell Street) and 1-3 Cooma Street as shown in Figure 1. The DCP was first introduced in 2019 when these properties were rezoned from industrial to residential use via Planning Scheme Amendment C210morn.

As well as rezoning the properties, Amendment C210morn introduced Schedule 1 to the Development Contributions Overlay (DCPO1) DCPO1, which applied the DCP to the land.

In 2022, Council commissioned an independent review of the DCP which identified several issues and risks that need to be addressed – the most significant being that the cost to deliver the infrastructure has increased substantially beyond what the DCP provides for.

Whilst some contributions have been collected under the DCP, Council does not have enough funds to deliver the infrastructure before the DCP expires. A revised DCP has therefore been prepared which Amendment C295morn proposes to introduce into the Planning Scheme to replace the current DCP.

The amendment also proposes to exempt the need for planning approval to remove native vegetation required to construct the infrastructure and other associated changes.

Note: The DCP has been amended twice by two separate planning scheme amendments in 2024 as follows:

In June 2024, Amendment C300morn extended the expiry date of the DCP from 6 June 2024 to 6 June 2026 to ensure the DCP remains in place so Council can keep contributions collected to date and continue collecting contributions while Amendment C295morn to introduce a new DCP is being progressed.
In July 2024, Amendment C305morn corrected technical errors that happened when Amendment C300morn was approved, including:
- Adding an exemption for small second dwellings from needing to pay contributions under the DCP because an earlier State Government amendment – Amendment VC249 exempted small second dwellings from DCP requirements in all Victorian planning schemes on 15 January 2024.,
- Updating the date of the DCP from 2018 to June 2024 to recognise when the DCP was revised by Amendment C300morn.

What is this amendment about?

Amendment C295morn proposes to replace the current Creswell Street East, Crib Point Development Contributions Plan (Watsons, June 2024) incorporated document with the proposed revised Creswell Street East, Crib Point Development Contributions Plan (Mesh Planning, December 2023) (‘revised 2023 DCP’). The revised 2023 DCP will provide for the funding and delivery of access and drainage infrastructure required to support the urban development of 76 parcels within the DCP area, as outlined in Figure 2 below.

What land is affected by the amendment?

Properties affected by Amendment C295morn include:

all land within the existing DCP area mapped as DCPO1 in the planning scheme, being: 1 - 73 Creswell Street (except 2 Creswell Street) and 1 - 3 Cooma Street, Crib Point, and
12 additional properties that are proposed to be included within the revised 2023 DCP area, including 2 Creswell Street (as shown in figure 2).

Why is the amendment needed?

Amendment C295morn is needed to provide a coordinated and equitable approach to the funding and delivery of local road and drainage infrastructure required to support residential development within the DCP area.

Specifically, the Amendment is required to revise the existing DCP as per the recommendations of the independent review commissioned by Council. (You can download a copy of this review from the Document Library on this webpage).

The revised 2023 DCP:

Extends the local road and drainage works to include the eastern edge of Creswell Street so it meets the existing road pavement and upgrade Cooma Street and Glossop Street between Creswell Street and Disney Street. This increases the total length of unmade local roads to be upgraded from 860 linear metres in the 2018 DCP to 1,138 linear metres in the revised 2023 DCP. The extension of the road and drainage upgrades will improve access and servicing outcomes for local residents and deliver two upgraded north-south local access roads.
Retains the project type and scope of the original DCP, meaning that the road cross-section remains the same and includes the construction of a 5.5 metre wide asphalt pavement and stormwater drainage, but does not include construction of a footpath.
Increases the DCP area because the extent of unmade road to be upgraded has been increased. The revised DCP will therefore include an additional 12 properties which are immediately adjacent to, and will benefit from, the upgraded local roads.
The section below details individual landowner DCP contribution levy costs per property.
Increases the total costs included in the DCP to account for the extended road length, updated construction costs (based on detailed design plans and Quantity Surveyor estimates), finance costs to deliver the project by 30 June 2028, and plan preparation costs.
Increases the DCP charges required due to the increase in total DCP costs.
Apportions 70% of all DCP costs to the landowners benefiting from the localised infrastructure, with Council to fund the remaining 30%. (The 70/30 funding split is the same as the original DCP which only covered road and drainage infrastructure construction costs – not finance and plan preparation costs as proposed in the 2023 DCP).
Increases the delivery timeframe of the project (i.e. infrastructure upgrades) to 30 June 2028.
Revises the demand units on which the DCP levies are calculated from ‘linear metre of lot frontage’ to ‘metre square of lot area’.
Includes a vegetation removal plan identifying the vegetation to be removed from private and public land to allow for the construction of the road and drainage infrastructure being delivered by the DCP. (It is noted that Amendment C295morn is also changing the Schedule 1 to Clause 52.17: Native Vegetation to exempt Council from needing a planning permit to remove native vegetation to deliver infrastructure under the DCP).

Landowner contributions under the revised 2023 DCP

Table 1 below sets out the estimated landowner contributions for each property under the revised 2023 DCP. Contributions will be charged according to the number of square meters per property. (Note: Figures are expressed in May 2023 dollars and are subject to quarterly indexation adjustments).

The DCP Parcel Number ID in table 1 corresponds to the property numbers shown in figure 4.

Did Council refer submissions to a planning panel?

Yes. Council decided at the Council meeting on 20 May 2025 to refer submissions to an independent planning panel for review and recommendations. The panel was appointed by the Minister for Planning.

Was there a public panel hearing?

Yes. A Directions Hearing was held on 30 June 2025. The Panel Hearing was held on 11 August 2025.

Where can I see panel-related documents?

The panel delivered its final report to Council on 9 September 2025. All panel-related documents including Council’s submission to the panel and the panel’s report can be found in the Document Library.

What happens next?

Once Council receives the panel’s report, it must consider the findings and recommendations outlined in the report before deciding whether to:

adopt the amendment (with or without changes recommended by the panel)
abandon all or part(s) of the amendment

If Council adopts the amendment (with or without changes), we will submit the amendment to the Minister for Planning for approval. The Minister’s decision on the amendment can’t be appealed. If the Minister approves the amendment, a notice will appear in the Victorian Government Gazette and the amendment will come into effect.

If Council abandons the amendment, we will notify the Minister, all affected landowners and submitters of Council’s decision and the planning scheme will not be changed.
