Over 1.6 million people stay overnight when visiting the Mornington Peninsula each year, making it the third largest short stay rental accommodation destination in Australia. The Mornington Peninsula Shire welcomes these visitors to the region but must also ensure that local communities continue to enjoy the benefits the area has to offer.

Short stay rental accommodation on the Mornington Peninsula is regulated through the Short Stay Rental Accommodation Local Law 2022.

Short stay rental accommodation on the Mornington Peninsula is regulated through the Short Stay Rental Accommodation Local Law 2022(PDF, 169KB) and the associated Code of Conduct(PDF, 135KB).

This Local Law and the Code of Conduct provide clear guidelines for the operation of short stay rentals by: 

  • Regulating their use
  • Ensuring an appropriate standard of management and presentation of accommodation
  • Minimising the risk of accommodation affecting the peace of the neighbourhood

If you own a short stay rental property on the Mornington Peninsula, the Short Stay Rental Accommodation Local Law 2022 requires you to register the property with Council each year.

Applications must include the details for your Designated Contact, a person who can respond to property issues within two hours at any time day or night. The details for the Designated Contact must be provided in writing to any adjoining neighbours of the short stay rental property.

Council's Short Stay Rental Accommodation Local Law 2022 places the responsibility on the owner to control the behaviour of the occupants of their short stay rental. All owners are required to:

  • Register the property with Council
  • Appoint a designated contact person to respond to neighbour complaints within two hours, day or night
  • Ensure occupants adhere to the Code of Conduct
  • Provide adequate off-street parking and garbage bins
  • Display their Council-issued registration number on all online platforms that advertise the property

The Local Law is in place to ensure that Short Stay Rental Accommodation can operate without having an impact on the surrounding area. An owner of a Short Stay Rental must:

What to expect from short stay rental property owners

Owners of Short Stay Rental Accommodation must adhere to a number of requirements. You may have a Short Stay Rental near you without even knowing it. Whilst most Short Stay Rental Accommodation can operate without having any impact, you may still expect some interaction with the owner.

The owner of a Short Stay Rental must provide the adjoining neighbours, including directly across the street, details for a designated contact. This person can be contacted 24/7 if there are any issues with occupants not complying with the code of conduct at a Short Stay Rental. Once the person is contacted, the Local Law requires them to respond to any complaints within two hours.

Reporting issues

If you experience any issues with a short stay rental property near you, there are several options available.

Call the Designated Contact. If you are experiencing any issues with occupants of a short stay rental, you can call the designated contact. This person is required to respond to any complaints within two hours, day or night.

Call the Council. Whilst Council may not be available to deal with the issue at the time, you can still report any issues. Council will contact the owner and, in the case of repeated serious issues, Council may cancel the short stay rental registration. To report an issue, please contact us or report online.

Call the Police. No-one should put themselves in danger when trying to deal with short stay rental issues. In the case of large parties, or violent and threatening behaviour, call 000 immediately.
