Amendment C256morn - 4 Bundara Crescent, Mount Eliza
Planning Scheme Amendment C256morn and Planning Permit CP22/002 is a combined planning scheme amendment and planning permit that provided planning permission to subdivide a single parcel of land at 4 Bundara Crescent, Mount Eliza into two lots.

Why is the amendment needed?
The land affected by C256morn is an irregular shape and size and is inconsistent with the surrounding subdivision layout and development pattern. Design and Development Overlay, Schedule 3, which affects the land, contains minimum subdivision-area requirements that restrict the land from being subdivided, unless the subdivision is in accordance with an approved Development Plan.
By applying the Development Plan Overlay to the site, Amendment C256morn has allowed a Development Plan to be approved to facilitate the granting of Planning Permit CP22/002 to subdivide the land into two lots. The subdivision provides for an extra, orderly designed residential lot that is consistent with the surrounding subdivision layout, on otherwise underutilised land.

The planning panel process
Council decided at the Ordinary Council Meeting on 15 July 2024 to refer submissions to an independent planning panel for review and recommendations.
Under delegation from the Minister for Planning, the Chief Panel Member of Planning Panels Victoria appointed the Panel Chair for C256morn on 24 July 2024.
The Directions Hearing occurred on 26 August 2024. Following the Directions Hearing, the Panel Chair determined on 29 August 2024 that the Panel Hearing would proceed by a written panel process in lieu of a public hearing. This decision was made based on the limited number of parties involved, and the confined issues to be considered.
After reviewing the submissions of both Council and the proponent, the Panel released its report on the combined amendment and permit on 18 September 2024. The report broadly supported the amendment.

What has Council decided to do with the amendment?
Council considered all submissions and the panel’s report and decided to adopt the amendment without changes during the Council meeting on 17 December 2024. You can view the amendment documents in the attachments to the meeting minutes.
Council has notified all owners and occupiers of land affected by the amendment of this decision and submitted the amendment to the Minister for Planning for approval on 20 January 2025.
What is the Minister for Planning’s decision?
The Minister for Planning has approved the amendment. Notice of the decision was provided to Council on 02 May 2025.
What happens now?
The amendment was gazetted on Thursday 22 May 2025. This means that the planning scheme has officially been changed as proposed by the amendment.
The Minister has directed Council to issue Planning Permit CP22/002.
