Road or Minor Reserve Discontinuance

Council may consider a road or reserve discontinuance and sale where the land was set aside for a specific purpose but is no longer required. 

Council's Discontinuance and Disposal of Roads Policy provides the principles and guidance required to ensure applications are dealt with in a transparent and consistent manner. Clause 3 of Schedule 10 of the Local Government Act 1989 and section 114 of the Local Government Act 2020 provide the regulatory framework which Council must comply with.

To apply to purchase a road or minor reserve, please fill in the application below. A land investigation fee applies to all applications and must be paid before the investigation will begin.

If Council decides to discontinue the road or reserve and sell the land to the applicant, the land will be sold at market value, and the land investigation fee will be deducted from the purchase price. All costs associated with the project such as conveyancing or solicitors' fees, must be paid for by the purchaser.
