The Mornington Peninsula Shire Council (Council) hereby gives notice, in accordance with section 114 of the Local Government Act 2020, that it is considering a proposal to sell a section of Council-owned land (the Land) between 8 and 10 Woodbyne Cresent, Mornington as shown on the plan below.
Council is proposing to sell the Land to the adjoining owner of the Land (Adjoining Owner), on the condition that the Adjoining Owner transfers to Council a new parcel of land within the Woodbyne Crescent area for use as public open space (Alternative Open Space).
The Alternative Open Space must be of at least equal land area to the Council Land and the purchaser will be responsible for developing it at their cost, including preserving existing vegetation and installing park infrastructure to Council requirements.
The transfer of the Alternative Open Space will be acquired by Council in accordance with section 112 of the Local Government Act 2020.
Feedback about the proposed sale should be submitted online at mornpen.vic.gov.au/woodbyne by 5pm Friday 23 January 2026.
