Amendment C295morn: Creswell Street East, Crib Point - revised DCP

The Creswell Street East, Crib Point Development Contributions Plan (Mesh Planning, April 2026) (DCP) is an Incorporated Document in the Mornington Peninsula Planning Scheme. The DCP provides for the funding and delivery of road and drainage infrastructure required to service privately owned residential properties in Creswell, Cooma and Glossop Streets, Crib Point.

The DCP specifically applies to properties located between 1-73 Creswell Street (inclusive), 9 Denman Street and 1-3 Cooma Street, Crib Point as shown in Figure 1. The DCP was first introduced in 2019 when land was rezoned from industrial to residential use via Planning Scheme Amendment C210morn (the Original DCP).

As well as rezoning the properties, Amendment C210morn introduced Schedule 1 to the Development Contributions Overlay (DCPO1), which applied the Original DCP area.

In 2022, Council commissioned an independent review of the Original DCP which identified several issues and risks that needed to be addressed – the most significant being that the cost to deliver the infrastructure increased substantially beyond what the Original DCP provided for.

Whilst some contributions were collected, Council did not have enough funds to deliver the infrastructure before the Original DCP expired on the 6 June 2024. A revised DCP was therefore prepared via Amendment C295morn.

Note: The DCP has been amended three times by separate planning scheme amendments, as follows:

  • In June 2024, Amendment C300morn extended the expiry date of the DCP from 6 June 2024 to 6 June 2026 to ensure the DCP remained in place so Council could keep contributions collected to date and continue collecting contributions while Amendment C295morn was being progressed.
  • In July 2024, Amendment C305morn corrected technical errors that happened when Amendment C300morn was approved, including:
    • Adding an exemption for small second dwellings from needing to pay contributions under the DCP because an earlier State Government amendment – Amendment VC249 exempted small second dwellings from DCP requirements in all Victorian planning schemes on 15 January 2024.,
    • Updating the date of the DCP from 2018 to June 2024, to recognise when the DCP was revised by Amendment C300morn.
  • In May 2026, Amendment C318morn extended the expiry date of the DCP from 6 June 2026 to 6 June 2027 to ensure the DCP remained in place so Council could keep contributions collected to date and continue collecting contributions while Amendment C295morn was being finalised 
 

What is this amendment about?

Amendment C295morn replaces the Original DCP incorporated document with the revised Creswell Street East, Crib Point Development Contributions Plan (Mesh Planning, April 2026) incorporated document.

The revised DCP provides for the funding and delivery of access and drainage infrastructure required to support the urban development of 66 parcels within the DCP area, as outlined in Figure 2 below.



What land is affected by the amendment?

Amendment C295morn applies to properties located between 1-73 Creswell Street (inclusive), 9 Denman Street and 1-3 Cooma Street, Crib Point, as shown in figures 1 and 2.

The infrastructure funded by this DCP is localised in nature, as it is upgrading the existing unmade local roads within the DCP area to generally include a 5.5m (from the invert of each kerb) sealed road that includes local drainage works. The upgrade of these roads will require removal of vegetation (which Council is seeking approval for now). Notably, Cooma Street has been designed to retain two Gippsland Manna Gums within the Cooma Street road reserve -adjacent to 90 and 92 Disney Street.  The extent of the road and drainage infrastructure works is shown in figure 2.

Why is the amendment needed?

Amendment C295morn was required to provide a coordinated and equitable approach to the funding and delivery of local road and drainage infrastructure required to support residential development within the DCP area.

Specifically, the Amendment was required to revise the Original DCP, as per the recommendations of the independent review commissioned by Council. You can download a copy of this review from the Document Library on this webpage.

The revised April 2026 DCP:

  • Extends the local road and drainage works to include the eastern edge of Creswell Street so it meets the existing road pavement and upgrades Cooma Street and Glossop Street between Creswell Street and Disney Street.

    This increased the total length of unmade local roads to be upgraded from 860 linear metres in the Original DCP to about 1,147 linear metres in the April 2026 DCP. The extension of the road and drainage infrastructure upgrades will improve access and servicing outcomes for local residents and deliver two upgraded north-south local access roads.

  • Generally, retains the project type and scope of the current DCP, meaning that the road cross-section remains the same and includes the construction of a 5.5 metre wide asphalt pavement and stormwater drainage, but does not include construction of a footpath. NOTE: The road and drainage infrastructure works have been redesigned to ensure the retention of two large Gippsland Manna Gums within the Cooma Street road reserve, adjacent to 90 and 92 Disney Street, Crib Point. This results in an amended roadway treatment for a portion of Cooma Street and is consistent with Council’s decision of 16 December 2025.

  • Increases the DCP area to include 2 Creswell Street, Crib Point, which is immediately adjacent to, and will benefit from, the upgraded local roads and drainage infrastructure works.

    NOTE: The DCP now applies to 2 Creswell Street, Crib Point (land owned and operated by South East Water).

    However, land owned and operated by South East Water, is exempt from development contributions. This means that no contribution is payable by South East Water, so long as the property remains owned and operated by South East Water.

    The DCP also includes other exemptions, consistent with the Victorian Planning Provisions and Development Contributions Guidelines.

  • Increases the total costs included in the DCP to account for the extended road length, updated construction costs (based on detailed design plans and Quantity Surveyor estimates), finance costs to deliver the project by 30 June 2030, and plan preparation costs.

  • Increases the DCP charges required due to the increase in total DCP costs.

  • Apportions a maximum of 70% of all DCP costs to the landowners benefiting from the localised infrastructure, with Council to fund at least 30% of the remaining costs. There are other costs that Council will fund, that cannot be included in the DCP.

    NOTE: The 70/30 funding split is the same as the Original DCP, which only covered road and drainage infrastructure construction costs.

  • NOTE: finance and plan preparation costs are also now included in the April 2026 DCP. 

  • Increases the delivery timeframe of the project to be delivered by 30 June 2030 (i.e. the road and drainage infrastructure upgrades).

  • Revises the demand units on which the DCP levies are calculated – from, ‘linear metre of lot frontage’ to ‘metre square of lot area’.

Landowner contributions under the revised 2025 DCP

Appendix 2 of the 2026 DCP (available via the below link) sets out the estimated landowner contributions for each of the 66 properties, based on the estimated total area of each property.

Contributions will be charged according to the number of square meters per property. Note: Figures are expressed in April 2026 dollars and are subject to quarterly indexation adjustments.

The DCP Parcel Number ID in Appendix 2 of the 2026 DCP below, corresponds to the property numbers shown in figure 2 above.

Did Council refer submissions to a planning panel?

Yes. Council decided at the Council meeting on 20 May 2025  to refer submissions to an independent planning panel for review and recommendations. The panel was appointed by the Minister for Planning.

 


Was there a public panel hearing?

Yes. A Directions Hearing was held on 30 June 2025. The Panel Hearing was held on 11 August 2025.

What has Council decided to do with the amendment?

Council considered all submissions and the panel’s report, and decided to adopt the amendment with changes, during the Council meeting on Tuesday, 16 December 2025 . You can view the updated amendment documents in the attachments to the meeting minutes.

What is the Minister for Planning’s decision?

The Minister for Planning has approved the amendment with no changes. Notice of the decision was provided to Council on 18 June 2026.


What happens now?

The amendment was gazetted on 25 June 2026. This means that the planning scheme has officially been changed as proposed by the amendment.
