Update on planning scheme Amendment C262morn 

Council Decision

 An independent planning panel has considered all submissions. Council has considered the panel’s report and recommendations and decided to adopt Amendment C262morn Part 2 with changes during the following meeting:

 15 June 2021 Planning Services Committee

Ministerial Decision

 The amendment has now been submitted to the Minister for Planning for approval. He makes the final decision on whether the amendment is approved.  

Council’s consideration of submissions and Planning Panel report 

Council considered all the submissions received during the exhibition period at its Planning Services Committee meeting on 14 December 2020. The report and committee decision can be found on the Council Meetings and Minutes page.

At the meeting, the Committee resolved to split the amendment into three parts:

Part 1: Adopt the part of the amendment proposing to include various properties within the HO where no unresolved submissions have been received and submit this part of the amendment to the Minister for Planning for approval.

Part 2: Refer all unresolved submissions on the amendment to an Independent Planning Panel.

Part 3: Abandon the amendment applying to the following places:

  •  2-4 Elizabeth Road, Portsea.
  • 876 Point Nepean Road, Rosebud.
  • 10 Esplanade, Sorrento.
  • 6 King Street, Sorrento.
  • 42-46 Ozone Avenue Sorrento

The planning panel was held on 15-19 February 2021, and on 24 February 2021. The panel chair undertook more site inspections on 9 March 2021.

Background

Amendment C262morn proposes to implement the recommendations of the Heritage Review Area 3 study applying to Blairgowrie, Portsea and Sorrento. This study was adopted by Council in August 2019. The amendment will introduce the Heritage Overlay to 65 individually significant places and six heritage precincts in Blairgowrie, Portsea and Sorrento on a permanent basis.

The amendment also affects a few places outside the Heritage Review Area 3 study area, in Arthur’s Seat, Rosebud, Somerville and Tyabb.

The purpose of the Heritage Overlay is to conserve and enhance heritage places and to ensure that any development does not adversely affect the significance of a heritage place.

The following sections list the properties and precincts proposed for heritage protection.

Each property and precinct have a link to a document called a heritage citation. The citations have been prepared by a qualified heritage consultant in accordance with the accepted standards for heritage assessment. The citation includes a ‘Statement of Significance’ that explains why it is a significant heritage place.

Precincts in the Heritage Review Area 3 study

Currently there is a large Heritage Overlay HO1 covering the Sorrento historic precinct. The study recommended that this large precinct be revised to exclude sites that have undergone significant change and do not have heritage significance. These areas are shown as pale yellow in the Sorrento map below.

It is proposed to introduce four new defined precincts in the Sorrento historic area covering the commercial, foreshore, cliff-top and residential areas. It is also proposed to introduce two new precincts in the study area, namely the East Sorrento precinct and the Back Beach Road, Portsea precinct.

The six precinct maps are shown below and if you click on the link below each precinct, you will able to see the citation document for that precinct. The citation map will show the properties that are contributory to the historic significance of the precinct and the properties that are non-contributory.
