Commercial activities on footpaths are any activity that is associated with the operation of an abutting business.
Permitted commercial activities within the Mornington Peninsula Shire include displaying goods, a-frame signs, tables and chairs, screens and planter boxes.

| How do I Obtain a Permit? | | A yearly permit fee applies.
You will need to complete a Commercial Activities on Footpaths application form and include with it: A plan/diagram showing the location and the number of items to be placed on the footpath as well as any existing infrastructure such as bins and seats. A copy of your Certificate of Currency of public liability insurance showing coverage of at least $10 million. Payment/evidence of payment of the appropriate fee.

| Requirements of Activities | | Requirements that must be complied with are: The minimum footpath width required to undertake a commercial activity is 2.5 metres wide The minimum width of the pedestrian zone is 1.8 metres and the minimum width of the kerbside zone is 0.7 metres All furniture, furnishings and equipment must be placed along the road side of the footpath at all times that they are on the footpath, even in inclement weather Permits for commercial activities must be displayed prominently at the front of the business The footpath may only be used for commercial activities during the hours of operation of the business No commercial activity may be placed directly adjacent to a designated access carpark space, bus stop, formalised pedestrian crossing or fire hydrant At all times during the period of the permit the business must maintain public liability insurance to the value of $10 million Where an officer of the Shire or the relevant road authority deems there is a safety risk due to the undertaking of commercial activity no commercial activities will be permitted. | Commercial Activities on Footpaths Policy | | The primary goal of the Commercial Activities on Footpath policy is to provide a practical balance between the competing needs and interests of pedestrians and businesses whilst ensuring that there is continuous, safe and dignified access to all.
To assist, the policy divides the footpath into three zones: a pedestrian zone, commercial activity zone and kerbside zone. The pedestrian zone is a 1.8 metre path extending from the property line that must be kept clear at all times.
The Shire adopted the Commercial Activities on the Footpath policy in June 2005. This policy provides guidance for the placement of commercial activities on footpaths in shopping precincts. The types of commercial activities that this policy effects include: Screens Planter Boxes Blinds, Awnings and Umbrellas Moveable Advertising Signs Display of Goods Outdoor Dining Facilities Gas Heaters Food Safety and Liquor Licences Cash Registers and Counter Facilities Markets Busking and Fundraising
